The material on this website is protected by copyright under the laws of Australia and may not be used without written permission by Shopmakers.

Shopmakers may revise these Terms of Use or the Terms of Purchase below at any time in its absolute discretion by posting revised terms, and these revisions will be effective immediately. If any of the terms are found to be unenforceable, you agree that the remainder of the Terms of Use and the Terms of Purchase remain in full force and effect.

Shopmakers provides this website and its contents on an “as is” basis, and to the extent permitted by law makes no representation as to the accuracy, completeness, currency or reliability of the information contained on this website.

If your use of this website or its content is subject to the New Zealand Fair Trading Act 1986 (“FTA”) and/or Consumer Guarantees Act 1993 (“CGA”), you may have rights or remedies which are not excluded or limited by the above. However, if you are using this website or its content for business purposes, are acquiring goods or services in trade through this website and are in trade yourself, then the above exclusions and limitations will still apply and you agree that the CGA will not apply. Similarly, if you are acquiring goods or services in trade through this website and you are in trade, then you agree to contract out of sections 9, 12A and 13 of the FTA.

2. Terms of Product Purchase

The Agreement

In addition to the Terms of Use, these terms and conditions (“the Purchase Terms”) set out the additional terms and conditions under which you may purchase from Shopmakers products appearing on this website. By completing the customer application process and purchasing products from this website, an agreement exists between you and Shopmakers once Shopmakers accepts an order. Each accepted order is a separate agreement.

Customer Application

You must complete the customer application process before placing any orders. You warrant that all information and data provided by you is accurate, complete and up to date. You will promptly notify Shopmakers if there is any change to this information or data. You must take responsibility for the safekeeping of your username and password, as you are liable if an unauthorised person uses your username and password.

Orders

You place an order with Shopmakers by selecting products and pressing the “purchase now” button on the checkout page. Shopmakers reserves the right to accept or reject an order for any reason including without limitation, unavailability of product; an error in the price, image or the product description; or error in your order. Orders are deemed received by Shopmakers at the time of successful transmission of the order, and you will thereafter be unable to cancel the order to the extent permitted by law. Orders are deemed accepted by Shopmakers upon Shopmakers acknowledging such order or failing to reject such order within 14 days. We only accept orders from New Zealand.

Product Availability

Shopmakers uses its best endeavours to ensure products ordered are available for delivery, and in most cases will notify you where a product is unavailable prior to you completing your order. However you acknowledge that in some cases this is not possible and Shopmakers may need to reject an order you have placed for a product where Shopmakers establishes that it is actually unavailable for delivery. In such cases Shopmakers will refund in full all amounts you paid in respect of such unavailable product. Shopmakers cannot provide rainchecks for products ordered online, and where permitted by law reserves the right to limit the sale of products to reasonable or normal household quantities.

Payment

You must pay for your products purchased on this website at the time of placing an order. We accept Paypal and all major credit cards including Mastercard, American Express, Diners Club and Visa. Products may also be purchased using Applepay, Googlepay.

Variation of Products and Price

Shopmakers may vary the prices on this website at any time, and prices are subject to change until you have paid for the products in full.

This Privacy Policy (Policy) explains how we collect, use and disclose information about our customers, suppliers (and their employees) and people who apply for employment with us. It also explains how to contact us if you have any questions about the management of your personal information or would like to access the personal information we hold about you.

This Policy describes how we comply with our obligations under the New Zealand Privacy Act 1993 as well as the privacy or data protection laws of other jurisdictions where we operate.

We may amend this Policy at any time by posting the updated version on our website.

Shopmakers is not responsible for the privacy practices of sites that are linked to this website via hyperlinks, banner advertising or otherwise.

What information do we collect?

Generally, the information we collect about customers includes your name, home or work address, delivery address, phone number, payment, credit and billing information, and e-mail addresses. we may also collect information about your computer, including your IP address.


We also collect information about your use of our website using cookies. You can choose to decline cookies, but if you do so, you may not be able to fully experience our online interactive features.

Ordinarily, customers can purchase goods from us without disclosing personal information, but in this situation we may not be able to provide you with the full range of services available.

3     Returns

We know from the feedback we receive from you that you love us to hunt down the best products at bargain prices. To do this we try to keep all of our costs down including the cost of covering returns from our customers and do not accept returns except where the basis of the return is covered by the Consumers Guarantees Act or Fair Trading Act. So when you’re at the checkout, take a second to run your eye over your order for any slips of the finger before submitting because once you’ve submitted it, it’s too late!!

If you think that you have a valid reason to return under the policies described below please contact us before sending your order back to us as the processes we use are different depending upon your situation. If you don’t contact us first it could delay your request or result in your claim being rejected. In all cases proof of purchase will be necessary to process your request.

Restrictions and Exceptions:

As a result of copyright laws and hygiene issues a refund or exchange is only available for the following products if the product is defective:

  • Mobile Phones
  • DVDs
  • PC and Gaming Console Software
  • Software
  • Confectionery
  • Consumables (perishable products some Health and Beauty/Pharmacy products)
  • Underwear swimwear
  • Jewellery (earrings)
  • Printer cartridges (when packaging is opened)

Refunds

In the unlikely event a product you have purchased from Shopmakers becomes faulty, we are committed to meeting our obligations under the New Zealand Consumer Guarantees Act 1993 (CGA). 

The New Zealand Consumer Guarantees Act 1993, is legislation that outlines the guarantees and rights of both the seller and consumer for products and services sold.

  • Under the CGA, products sold by us must be safe, of acceptable quality, fit for the purpose they have been purchased for, match the description given, match the sample or demonstration model and be of acceptable condition when received by you;
  • The CGA guarantees are in addition to any other warranty offer(s) provided by the manufacturer, or insurance provider (if applicable); and
  • The CGA does not apply where the product has been misused, broken or improperly operated.

Where you buy a product that is supplied by a Merchant, our Buyer Guarantee outlines the process to follow if you believe you have the right to a replacement or refund, or if you think your goods have been damaged or lost during delivery. As set out in the Buyer Guarantee, you must lodge any complaint you may have through our Platform. Once your complaint has been lodged, we will liaise with the relevant Merchant to resolve your complaint. We will attempt to resolve complaints as quickly as possible and rely on you to promptly provide all the information needed to resolve your complaint.

In respect of products that are supplied by us:

·        Minor fault: If a product that is does not meet one of the guarantees detailed above or cannot be repaired within a reasonable period of time, we will either repair or replace the product with an identical product type. In the event a repair or replacement is not a viable option, or the repair cannot be carried out within a reasonable period of time, Shopmakers will refund you the original purchase price.

·        Major fault: In the event a product cannot be repaired, due to the nature of the fault (safety risk) or the failure is of substantial character (i.e. multiple product failures), you may choose either a replacement of an identical product type or a refund of the original product purchase price.

When the product is initially returned, we can try to fix (troubleshoot) the problem, in consultation with the supplier, before sending it to an authorised repair agent for assessment.

Product misuse, accident, or wear and tear is not covered by our warranty policy.

If you feel that your purchase has a fault that is covered under Shopmakers warranty please contact us, including as much detail as possible (including a photo of the issue if possible or applicable) so that we can assess the problem and advise you of a solution. This could be either a repair, replacement or refund. We reserve the right to provide the best possible solution based on availability of stock.
